BI Claim Calculator, including its calculation methodology, report formats, user interface design, written content, and underlying source code, is the exclusive proprietary intellectual property of BI Claim Calculator. Unauthorised copying, reproduction, distribution, or commercial exploitation of any part of this tool is strictly prohibited and may result in civil and criminal liability.

1. Acceptance of Terms

By accessing or using the BI Claim Calculator tool (the "Tool"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must immediately cease using the Tool. These Terms constitute a legally binding agreement between you ("User") and BI Claim Calculator ("we", "us", "our").

We reserve the right to modify these Terms at any time. Continued use of the Tool after any modification constitutes your acceptance of the updated Terms. The date of the most recent revision is displayed at the top of this page.

2. Intellectual Property Ownership

All content, features, and functionality of the Tool — including but not limited to the calculation engine, report templates, PDF and Excel output formats, user interface design, graphics, text, FAQ content, methodology documentation, industry benchmark data, and source code — are the exclusive intellectual property of BI Claim Calculator and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

The BI Claim Calculator name, logo, and all related marks are proprietary to BI Claim Calculator. Nothing in these Terms grants you any right, title, or interest in or to our intellectual property, except for the limited licence expressly set out in Section 3.

The calculation methodology implemented in this Tool is based on the ISO Business Income Worksheet standard and has been independently developed, structured, and implemented by BI Claim Calculator. Our specific implementation, including the OLS regression engine, three-scenario modelling framework, and report generation pipeline, constitutes original proprietary work.

3. Licence to Use

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Tool solely for your own internal business purposes — specifically, to calculate and document a business interruption insurance claim for a business in which you have a legitimate interest.

This licence does not permit you to: (a) use the Tool on behalf of third parties on a commercial basis without our prior written consent; (b) resell, sublicence, or otherwise commercialise access to the Tool; or (c) use the Tool to develop a competing product or service.

4. Prohibited Uses

You must not, directly or indirectly:

  • Copy, reproduce, distribute, publish, or transmit any part of the Tool or its outputs for commercial purposes without our prior written consent.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, calculation methodology, or trade secrets of the Tool.
  • Modify, adapt, translate, or create derivative works based on the Tool or any part of it.
  • Remove, alter, or obscure any copyright, trademark, proprietary rights notice, or other legal notice displayed in or on the Tool.
  • Use the Tool to build, train, or improve any competing product, service, or machine learning model.
  • Scrape, crawl, or systematically extract data, content, or outputs from the Tool by automated means.
  • Misrepresent the source or authorship of any report generated by the Tool.
  • Use the Tool in any manner that violates applicable law, regulation, or the rights of any third party.

5. Report Outputs and Permitted Use

Reports, workbooks, and other outputs generated by the Tool ("Outputs") are licensed to you for the sole purpose of supporting a specific business interruption insurance claim. You may share Outputs with your insurer, broker, legal counsel, public adjuster, or forensic accountant in connection with that claim.

You may not: (a) sell, license, or distribute Outputs to third parties as a standalone product; (b) present Outputs as having been prepared by a licensed forensic accountant or other regulated professional unless independently reviewed and endorsed by such a professional; or (c) use Outputs in any context that implies a professional endorsement that does not exist.

6. No Professional Advice

The Tool and all Outputs are provided for informational and analytical purposes only. Nothing in the Tool or any Output constitutes legal, accounting, insurance, financial, or professional advice of any kind. The Tool does not create any professional relationship between you and BI Claim Calculator.

You are solely responsible for verifying the accuracy of all data you enter into the Tool, and for obtaining independent professional advice before submitting any insurance claim. We strongly recommend that all claims, particularly those of significant value or involving coverage disputes, be reviewed by a qualified forensic accountant, public adjuster, or insurance lawyer.

7. Data Privacy

The Tool is designed with a zero-server-storage architecture for claim data. All financial data you enter — including revenue figures, expense amounts, and scenario parameters — is processed and stored exclusively in your browser's local storage on your own device. This data is never transmitted to our servers.

The only personal data we collect is your name and email address, and only if you voluntarily opt in to product updates. This data is stored securely and is not shared with third parties for marketing purposes. Payment processing is handled by Stripe, a PCI-DSS Level 1 certified payment processor. We do not store payment card details.

8. Accuracy and Disclaimer of Warranties

The Tool is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

We do not warrant that: (a) the Tool will be error-free or uninterrupted; (b) the calculation results will be accepted by any insurer, court, or regulatory body; (c) the industry benchmark data is current or applicable to your specific business; or (d) the Outputs will be sufficient to support your claim without additional professional analysis.

The accuracy of all Outputs depends entirely on the accuracy and completeness of the data you enter. We are not responsible for errors arising from incorrect, incomplete, or fabricated input data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BI Claim Calculator and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or any other commercial losses, arising out of or in connection with your use of the Tool, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Tool shall not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BI Claim Calculator and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Tool; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any claim that your use of the Tool infringes the rights of any third party.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms constitute the entire agreement between you and BI Claim Calculator with respect to your use of the Tool and supersede all prior and contemporaneous agreements, representations, and understandings. No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorised representative of BI Claim Calculator.
